If Ed McMahon were Chief Justice...

... would he be an activist judge, pushing for the federal government to fulfill each person's right to a relaxing bath? Would he push for the Jeffersonian ideal of high bathtime mineral content? Would he successfully tread the narrow path between Franklin's belief that each man should pick his own bath temperature and Roosevelt's belief in bath safety through government control? If he mandated minimum water temperatures, would he provide funding for implementation of the mandates? But most importantly, would he bring bath salts and a loofah?

Or is "A relaxing bath is something we all have a right to" just more election-cycle rhetoric?
